As you begin your construction activities, please keep in mind, the Lynn Park Civic Association
(LPCA) has an Architectural Review Process to help maintain the quality of our neighborhood.
As part of this process, LPCA retains an architect to consider and review each homeowner’s plans for exterior changes, modifications and new builds. Together with the Architectural Review Committee, each plan is objectively reviewed against the Lynn Park Deed Restrictions and written interpretations.
Once complete, the architect provides appropriate feedback to the homeowner for correction or issues a final no-objection letter. A no-objection letter indicates that the exterior changes, modifications or rebuilds can proceed, with the necessary city permits secured.
Please note applications for new construction, pools or major remodels must be submitted with an application fee (payable via the Resident Portal or cashier’s check, check, or money order) and submitted to Montage Community Services. Applications for rebuilds require both the builder deposit and plan review fee. Within 24-hours of fee submittal, Montage Community Services will issue a payment receipt to you and will copy the association’s architect and the Lynn Park Architectural Review Committee. Current Deed Restrictions Interpretations
• Driveway dimensions for front loading garages on non-side streets – enforce 12’ with flares
• Driveway re-positioning that causes a tandem driveway effect with neighboring property. Not allowed.
• Improvements in parkway and 25’ setback. i.e. tombstone mailbox; address markers; or large-scale hardscape/landscape improvements – No. Interpretation of no structures in 25’ setback. See 5.5 / 5.5.4 / 6.1
• Swimming pools in side and rear setbacks. No. Coping, decking and other improvements surrounding the pool are permissible in setback area. Includes other water features.
• Porches/stoops/other items inside 25’ setback. No. See 5.5 / 5.5.4 / 6.1
• Rooftop placement of mechanical equipment. Should be screened from view, as interpreted from deed restriction intent for other such equipment. Condensing units, solar panels, water collection / recovery systems, and other mechanical items
• Adherence to all COH Ordinances – i. e. COH Tree and Shrub Ordinance
• Window Replacement. An architectural review is not needed, if replacement occurs with windows (and doors) that do not alter the exterior dimensions of the residence. The only instance where a review would be needed includes the potential addition of a window (or door) on the second floor of the detached garage facing the rear or interior lot line – see section 5.6.2.
• Builder, Contractor, and Other Signs - Not allowed as described in Section 4.5.

Any new construction or remodel that involves changes to the exterior dimensions of a home, garage, pool, fence, driveway or other hardscape feature, must receive Association approval to be in compliance with our Deed Restrictions . The Deed Restrictions and associated documents are posted on www.lynnpark.org in the Documents Section.
Homeowners must submit plans (electronic preferred) to the Montage Community Services, along with the designated fees, payable to the Lynn Park Civic Association ("LPCA"). Upon receipt, Montage Community Services will forward the plans to the LPCA Architectural Review Committee, as well as the Association's Architect for review. Properties with an outstanding balance and no payment arrangement will be immediately denied until rectified.

Homeowner Application Fee Receipt
This building plan approval procedure seeks to assure that all construction and/or renovation activities conform with the Deed Restrictions and associated documents filed in the Real Property Records. Upon final review and check for compliance, the homeowner will receive a "No Objections” letter to affirm that submitted plans comply with the Deed Restrictions and associated documents filed in the Real Property Records at that time.
FEES ARE DUE BEFORE PLANS ARE SUBMITTED FOR REVIEW
The fee for new home construction plan review is $2,500.00.
The fee for remodel of a home, including garage re-builds or additions is $1,500.00.
The fee for driveway, pool and fence changes, which alter the dimensions of the home, is $500.00.
Specific to new home construction plan reviews, the Association requires an executed Builder Deposit Agreement in the amount of $7,500.00. This deposit should be made payable to Lynn Park Civic Association, separate and apart from the new home construction plan review fee, specified above. The Association will collect these funds at the time the plans are submitted for review.
IMPORTANT NOTE: In all instances, these fees provide for two rounds of reviews by the Association's architect and Architectural Review Committee. Should additional reviews and corrections be required by the homeowners, an additional fee will be collected at the association's architect's prevailing standard rate.

Lynn Park Civic Association (LPCA) requires a deposit (Deposit) from the Builder (Builder) for any new home construction. The execution of this "Builder Deposit Agreement" is a condition of acceptance by LPCA, through its Building Plan Approval Procedure. This executed agreement is one of the required items in that submission. Under no circumstances shall any new construction or related activities be commenced prior to the final "No Objections" letter from LPCA's external architect of record.

BUILDER DEPOSIT AGREEMENT
EFFECTIVE DATE: February 7, 2018
For and in consideration of the mutual covenants set forth in the Agreement, the Owner(s) and Builder hereby agree to the following:
1) Builder agrees to submit to LPCA, upon execution of this agreement, a check in the amount of $7,500.00, made payable to Lynn Park Civic Association.
Note: No interest on the Deposit shall be paid to the Builder
2) Builder agrees to complete this project in a timely manner and in accordance with the No Objections letter and this Agreement. Notwithstanding the approval of the No Objections letter, the Builder also agrees to complete this project in accordance with the LPCA restrictive covenants and interpretations, as filed in the Harris County Real Property Records. It is the Builder's responsibility to notify the LPCA promptly of any conflict between the approved No Objections letter and the Restrictive Covenants and subsequent Interpretations. Upon determining the existence of any such conflict, the Builder shall be required to refrain from continuing the project until the conflict is resolved to the satisfaction of LPCA.
3) Prior to commencement of demolition to existing structures and/or improvements on the project lot, the Builder must install construction fencing as described in the Restrictive Covenants and subsequent Interpretations. This includes both temporary construction fencing, as well as fencing the critical root zones of existing trees in the 25' building setback.
• Note: Owner(s) must preserve trees twenty (20) inches or more in diameter between the right of way and the building setback area long their block. Refer:"' Interpretations of Restrictive Covenants [RP- 2016-562854] (filed 12/15/2016)
4) Prior to commencement of construction, the Builder must give written notice to all property owner(s) adjacent to the project lot and the owner(s) of properly directly across the street, as well as the owner(s) of the lots on either side of the lot immediately across the street of (a) the date construction will commence, and (b) emergency telephone number(s) of the Builder and/or the Builder's superintendent in charge of construction at the site. For corner lots, the owners across both the main and side street must benotified.
5) The Deposit shall be held by LPCA to assure compliance with this Agreement. The Builder acknowledges that the Restrictive Covenants and subsequent Interpretations include rules and regulations relating to construction including, by way of example and not in limitation, starting and ending times for construction work and maintenance of and surrounding the construction site. A violation of any pf the rules or regulations set forth in either the Restrictive Covenants and subsequent Interpretations may result in a written notice to Builder. Any violation of the same rules or regulations after written notice is given to Builder may result in the forfeiture of a portion of the Deposit. Additionally, the Owner(s) and Builder must be familiar with the LPCA "Restrictive Covenant Violation Enforcement Process and Associated Violation Fee Details" document. 6) All or any portion of the Deposit may be forfeited by Builder for violations to this Agreement, or other violations of the Restrictive Covenants and subsequent Interpretations than those addressed in paragraph 5 above. A schedule of the forfeitures for the other types of violations is set forth in the Forfeiture Schedule below. No prior notice is required for a forfeiture resulting from a violation set forth in this schedule.
• Failure to notify all adjoining property owners
• Failure to install construction fencing and tree protection
• Improvement not in approved location with no encroachments
• Improvement not in approved location and with encroachments
• Failure to comply with building height limitation
• Failure to complete construction within twelve (12) month period
7) The Deposit shall be refunded to Builder as follows:
$500 per owner
$500 first time, $100 each additional day $1,000 and then, $250 each occurrence
$2,500 each occurrence
$2,500 each occurrence
$100 per day unless a variance has been granted
• Within thirty (30) days of the date of receipt by LPCA via written notice by the Builder that the project is substantially complete. For these purposes, the date of substantial completion for new home construction shall be the date on which the new home may be occupied.
• If LPCA determines that there are deviations from the approved No Objections letter or non-compliance with the Restrictive Covenants and subsequent Interpretations, the Deposit shall not be refunded until all deviations are brought into compliance with the approved No Objections letter, the Restrictive Covenants, and subsequent Interpretations .
• If LPCA receives notice of damage to structures, improvements, and/or property by any adjoining property owners, the parties agree that these claims or controversies will be directed to LPCA's counsel of record for relief and resolution. Therefore, the Deposit shall not be refunded until all claims or controversies are resolved to the satisfaction of all parties.
